## What to know before you apply

India has no digital nomad or remote-work visa. Verified against the Bureau of Immigration's complete 13-type list of visas (Business B, Diplomatic D, Work/Employment E, Family F, Journalist J, Medical M, Official O, Pakistan-specific P, Student S, Tourist T, Transit TR, Miscellaneous X and Long Term) and the nine e-Visa sub-categories — none is a nomad or remote-work category — and by a keyword sweep for "nomad" across the BOI visa list, Tourism in India and Work in India pages, which returned zero hits. REMOTE WORK IS NOT PERMITTED ON A TOURIST VISA: the T1 Tourist Visa is defined for "recreation, sightseeing, casual visit to meet friends or relatives", short-term yoga, short medical treatment, non-formal short courses and unpaid short-term voluntary work, and the BOI states separately that "Foreigners who desire to work in India should arrive on a valid Employment visa." CLOSEST LONG-STAY ROUTES. (1) The five-year e-Tourist Visa is the longest-validity self-service option — "Duration: Five years from the date of grant of ETA. Entries: Multiple" — but "Maximum aggregate stay by a foreigner in India on an e-Tourist Visa or both should not exceed 180 days in a calendar year" and "e-Tourist/ Tourist visa shall not be extended and converted." Fees per the schedule dated 9 July 2026: USD 160 for the USA, USD 200 for Australia and most nationalities, USD 484 for the UK, USD 25 for Japan, plus a 3% bank charge. (2) The e-Business Visa (e-B1 V) runs one year, multiple entry, with "Continuous stay during each visit shall not exceed 180 days"; USD 120 for most nationalities. (3) The Employment Visa E-1 requires engagement by an Indian or project-executing foreign company and a gross salary "in excess of Rs. 16.25 lakhs per annum", with "No change of employer shall be permitted during the currency of the employment visa" — not available to a remote worker with a foreign employer. (4) The OCI card is "only a life-long visa" but is restricted to people of Indian origin and qualifying spouses. (5) Permanent Residency Status exists for foreign investors. Currency note: the Employment Visa salary floor is published in Indian Rupees (lakhs per annum) and all e-Visa fees in US Dollars; neither has been converted.

## What it means for your tax days

A visa is permission to stay; tax residency follows the days. India treats you as tax resident once you are present 182 days 182 days or more in the tax year; alternatively 60 days or more in the tax year combined with 365 days or more in the four preceding years, and residents are taxed on worldwide income. Days are not the only test: Section 6(2), Income-tax Act, 2025: "An individual shall be resident in India in a tax year, if he— (a) is in India for a total period of one hundred and eighty-two days or more in that tax year; or (b) is in India cumulatively for sixty days or more during that year and has been in India cumulatively for three hundred and sixty-five days or more in the four years preceding such tax year." RELAXATIONS: s.6(3) disapplies limb (b) for an Indian citizen who leaves India in the tax year as a member of the crew of an Indian ship or for the purposes of employment outside India; s.6(4) disapplies limb (b) for an Indian citizen or person of Indian origin who, being outside India, comes on a visit to India — so only the 182-day test applies to them. s.6(5): where such a visitor has total income exceeding fifteen lakh rupees in the tax year (other than income from foreign sources), limb (b) applies "as if the words 'sixty days' had been substituted with 'one hundred and twenty days'". DEEMED RESIDENCE, s.6(7): irrespective of the above, an individual is deemed resident if he (a) is a citizen of India, (b) is not liable to tax in any other country or territory due to his domicile, residence, or similar criteria, and (c) has total income exceeding fifteen lakh rupees in the tax year (other than income from foreign sources); s.6(8) disapplies this to anyone already resident under s.6(2)–(6).
