## How the counting works

Ecuador has two day-count limbs, and the second is the one nomads miss: 183 days measured across a rolling 12-month window that straddles two fiscal periods, not just within one. Sporadic absences are expressly counted in, so short trips out do not reset the clock. Worldwide taxation is confirmed by LRTI article 2, which brings into charge 'los ingresos obtenidos en el exterior por personas naturales domiciliadas en el país'. The tax year was read from SRI's own Impuesto a la Renta page: 'El ejercicio impositivo comprende del 1 de enero al 31 de diciembre'. The law text was read from the PDF hosted on sri.gob.ec.

## Why the day count is the part you can control

Ties, homes and intentions are argued after the fact; days are a record. That is why the first thing an adviser asks for is a list of the days you were in the country — and why reconstructing it from boarding passes and photos a year later is a bad afternoon. Log each stay as it happens and the tally is simply there, with the dates that produced it. ## Questions people ask about Ecuador tax residency

**How many days can you spend in Ecuador before becoming tax resident?**

183 days Ley de Régimen Tributario Interno article 4.1: an individual is an Ecuadorian tax resident when '(a) su permanencia en el país, incluyendo ausencias esporádicas sea de ciento ochenta y tres (183) días calendario o más, consecutivos o no, en el mismo periodo fiscal' — 183 calendar days or more, consecutive or not, including sporadic absences, in the same fiscal period; or '(b) ... en un lapso de doce meses dentro de dos periodos fiscales' — 183 calendar days or more within a 12-month span falling across two fiscal periods, unless the person proves tax residence for the corresponding period in another jurisdiction where the main nucleus of their activities or economic interests is located, in which case residence in Ecuador is otherwise presumed. makes you tax resident in Ecuador, and residents are taxed on worldwide income. Days are not the only route in: Article 4.1(c): residency also arises where the main nucleus of the person's activities or economic interests is in Ecuador, directly or indirectly. That nucleus is in Ecuador where, in the last twelve months, the person obtained the greatest value of income compared with any other country (valued at the period's average exchange rate), or where the greatest value of their assets is in Ecuador. It is presumed where a person holds, directly or indirectly, Ecuadorian assets — including capital rights in resident companies or permanent establishments — worth more than USD 1 million, and at any time before or during the relevant fiscal year has been an Ecuadorian tax resident, has held Ecuadorian nationality or permanent residence, or has acted as legal representative or attorney of a resident company or Ecuadorian permanent establishment of a non-resident company. Anti-avoidance: a person claiming residence in a tax haven or lower-taxation jurisdiction must prove at least 183 calendar days there in the relevant period and that their main nucleus is there; an Ecuadorian tax resident who later claims residence in a tax haven or preferential regime keeps Ecuadorian residency for the four following fiscal periods unless they prove otherwise.
