## How the counting works

SOURCE CAVEAT: the text quoted here was read from net.jogtar.hu, which is operated by Wolters Kluwer and is therefore a secondary source, because the official National Legislation Database (njt.hu) did not respond and NAV's English site states it is under construction. The officialUrl points at njt.hu for the same act but was not successfully retrieved. Day-counting convention stated in the statute: 'a ki- és beutazás napját is egész napnak tekintve' — the day of departure and the day of entry each count as a whole day. Section 2(4) states that a resident individual's tax liability extends to all their income (teljes körű adókötelezettség), which is the basis for worldwideIncome: true; a non-resident is taxed only on income from Hungarian sources or otherwise taxable in Hungary under a treaty.

## Why the day count is the part you can control

Ties, homes and intentions are argued after the fact; days are a record. That is why the first thing an adviser asks for is a list of the days you were in the country — and why reconstructing it from boarding passes and photos a year later is a bad afternoon. Days are not the only route in: Section 3(2) of Act CXVII of 1995 on personal income tax defines a Hungarian resident individual as: (a) a Hungarian citizen, except one who is simultaneously a citizen of another state and has no registered domestic residence or place of stay; (b) a natural person with free-movement and right-of-residence-over-three-months status who exercises that right in Hungary for at least 183 days in the calendar year; (c) a person with long-term residence status under the third-country nationals act, or a stateless person; and (d) any other natural person who (da) has a permanent home only in Hungary, (db) has their centre of vital interests in Hungary where they have no permanent home or a permanent home in more than one state, or (dc) has their habitual abode in Hungary where the permanent home and centre of vital interests tests do not resolve it. The law defines the centre of vital interests as the state to which the person's closest personal, family and economic ties bind them, and a permanent home as one arranged for lasting occupation and actually lived in; a temporary long stay abroad does not change the permanent home.
