## How the counting works

Section 7(1A) ITA 1967: "an individual shall be deemed to be in Malaysia for a day if he is present in Malaysia for part of that day", and days need not form a continuous period for paragraphs (a) and (c). Section 7(1B) deems a Malaysian citizen employed in the public service or a statutory authority to be resident while serving or fully-sponsored studying outside Malaysia. Scope of charge, per LHDN: "Income tax shall be charged for each year of assessment upon the income of any person accruing in or derived from Malaysia or received in Malaysia from outside Malaysia", but "Any source of income derived from outside Malaysia and received in Malaysia is tax exempted." In practice, therefore, resident individuals are not taxed on foreign-source income — hence worldwideIncome false. This exemption for individuals has been granted by ministerial exemption order since 2022; LHDN's page states it as current but does not state an expiry date, so the expiry was not verified. Resident status matters mainly for access to graduated rates, reliefs and treaty benefits: "non-resident individuals are taxed at a flat rate of 30% and are not eligible to enjoy any reliefs."

## Why the day count is the part you can control

Ties, homes and intentions are argued after the fact; days are a record. That is why the first thing an adviser asks for is a list of the days you were in the country — and why reconstructing it from boarding passes and photos a year later is a bad afternoon. Log each stay as it happens and the tally is simply there, with the dates that produced it. **How many days can you spend in Malaysia before becoming tax resident?**

182 days 182 days or more in a basis year (the calendar year corresponding to a year of assessment) makes you tax resident in Malaysia; the system is territorial, so foreign income may fall outside it. Days are not the only route in: Section 7(1) ITA 1967 gives four alternative tests. (a) In Malaysia for periods amounting in all to 182 days or more in the basis year. (b) In Malaysia for less than 182 days where that period is LINKED by or to another period of 182 or more consecutive days in Malaysia falling in the immediately preceding or immediately following basis year — with the proviso that temporary absences (i) connected with service in Malaysia, service matters, conferences, seminars or study abroad; (ii) owing to ill-health of the individual or an immediate family member; and (iii) social visits not exceeding 14 days in aggregate, count as part of the period if the individual is in Malaysia immediately before and after the absence. (c) In Malaysia for 90 days or more in the basis year, having been either resident or in Malaysia for 90 days or more in each of any three of the four preceding years of assessment. **When is Malaysia's tax year?**

1 January – 31 December. Day counts are measured against that year unless the rule names a different period — here, 182 days or more in a basis year (the calendar year corresponding to a year of assessment).

**Are residents of Malaysia taxed on worldwide income?**

Not in the usual way: Malaysia taxes on a territorial basis, so foreign-source income may fall outside the net. Confirm your own position with the authority or an adviser.
