## How the counting works

The UAE levies NO personal income tax, so taxYear is null and worldwideIncome is false: "The UAE does not levy income tax on individuals" (u.ae, the UAE Government's official platform). Cabinet Decision No. 49 of 2023 confirms that "Wage or salary, such as earnings from employment", personal investment income and real estate income (where no licence is required) are not Business or Business Activity and so fall outside Corporate Tax. The day tests above exist to determine tax residency for TAX RESIDENCY CERTIFICATE and treaty purposes, not to trigger a domestic tax charge. Legal basis: Article 53 of Federal Decree-Law No. 28 of 2022, Cabinet Decision No. 85 of 2022 on the Determination of Tax Residency, and Ministerial Decision No. 27 of 2023. The FTA's TRC service page splits its documentary requirements into Case 1 (183 days or more), Case 2 (90 to 182 days) and Case 3 (primary residence and centre of interests); it was last updated 11 August 2026. CAVEAT: the PDF of Cabinet Decision No. 85 of 2022 itself is not reachable on tax.gov.ae (the legislation index exposes only a rolling recent subset) and uaelegislation.gov.ae returns 403 to automated requests. The commonly cited effective date of 1 March 2023 could NOT be confirmed from an official page and is therefore not asserted here; the FTA guide names and article-references the decision throughout but does not state its commencement date. A TRC covers "a Tax Period, or any other 12-months period, selected by the applicant".

A Permanent Place of Residence is "a furnished house, apartment, room or other form of dwelling, which a natural person has arranged to have made continuously available to them"; it need not be owned, and a dwelling occupied only occasionally or temporarily for travel, leisure or education does not count.
